ISSUANCE OF AIR CARRIER CERTIFICATE (INITIAL CERTIFICATION)

Air carrier certificate means a certificate issued following certification that confirms compliance with the applicable requirements.

An air carrier certificate may be issued to a company registered in the Register of Legal Entities of the Republic of Lithuania, whose main place of business is in the Republic of Lithuania and which meets the applicable requirements of Regulation (EU) 2018/1139 and the delegated and implementing acts adopted based on it.

The process of issuing an air carrier certificate consists of the following stages:

  1. preparation for submitting an application;
  2. filing an application;
  3. evaluation of application documents;
  4. inspections;
  5. adoption of a decision on the issuance of an air carrier certificate and issuance of an air carrier certificate.

A company intending to submit an application for an air carrier certificate (candidate) applies to the Public Transport Competence Agency. An information package on the procedure for issuing an air carrier certificate is provided to the candidate.

The candidate, having familiarized himself with the information provided to him, submits a completed declaration of the planned activity:

By the order of the director of the Public Enterprise Transport Competence Agency, an employee is appointed who performs the functions of a certification coordinator for obtaining an air carrier certificate.

Upon receipt of the declaration of the planned activity, a preliminary meeting is organized in which representatives of the candidate and representatives of the Public Transport Competence Agency (Certification Commission) participate.

After the preliminary meeting, the Certification Commission provides the candidate with information and a decision regarding the candidate’s preparation for the process of issuing an air carrier certificate.

After the Certification Commission determines that the applicant has submitted all the necessary documents and data, a meeting between the Certification Commission and the applicant’s representatives is organized.

After the meeting, the applicant is informed about the acceptance of the application and the start of the evaluation of the application documents.

After evaluating the application documents and data, the specialists of the Public Enterprise Transport Competence Agency check whether the applicant is ready to carry out air transport activities and meets the requirements stipulated in Regulation (EU) No. 965/2012 in point c of part ORO.AOC.100 of Annex III.

TKA specialists start the applicant’s checks only when:

1. the applicant submitted all the necessary documents and data and they were approved or the applicant was informed about the absence of comments if the documents are not approved;

2. the responsible manager of the applicant declared in writing that the internal audit of the applicant’s activities was completed in accordance with Regulation (EU) No. 965/2012 requirements, and submitted this audit report to the coordinator.

After the inspection, the specialists of the Transport Competence Agency of Public Enterprise Transport inform the applicant in writing about the results of the inspection and, if inconsistencies are found during the inspection, set a deadline for submitting corrective action plans.

When the applicant’s inspections have been carried out and the discrepancies identified during the inspections have been corrected, or the deadline set in the corrective action plan has expired and the applicant has not corrected the discrepancies, the specialists of the Public Enterprise Transport Competence Agency inform the coordinator about this. A meeting of the Certification Commission is being organized.

The certification commission submits a recommendation to the director of the Public Enterprise Transport Competence Agency regarding the issuance or non-issuance of an air carrier certificate.
